Damage Liability & Valuation It is understood and agreed between the parties hereto that the limit of the carrier’s liability is 60 cents per pound weight of each article, unless other written and acknowledged liability is reached between the parties of this agreement, and that any claim arising from this shipment shall be settled on this basis. Evidence of Valuation in the amount you declare will be issued upon your express written direction. 2. Limited Liability of Loss & Damage The carrier shall not be accountable for loss or damage to contents of drawers, packages, or containers not packed by our employees, nor for silverware or other items of excess value unless due notice has been given our carrier. This included money, green stamps, jewelry and firearms, etc. We will not accept perishable items including plants. 3. Required Evidence of Valuation for Stored Items Delivery of goods to our warehouse for storage will be followed by the issuance of a receipt enumerating articles received and containing terms and conditions upon which they are accepted for storage. Nothing in this agreement states or implies that your properties are automatically insured in any amount while kept in our care and custody. Evidence of Valuation in the amount you declare will be issued upon your express written direction. 4.Limited Liability for Electronics & Equipment The carrier shall not be liable for mechanical damage of major appliances such as: Washing Machines, Refrigerators, Ranges, Home Freezers, TV sets, HiFi Sets, Stereos, Radios and Record players, etc. unless evidence of the dropping or other negligent handling of the article is evident. 5. Invoice Terms It is further agreed by the shipper that in the event payment is not made at the delivery that a laborer’s lien is expressly granted on all furniture, fixtures or house hold goods that were transported. Payment is expected at the completion of the move, unless prior arrangements are made before the move. All invoices are net due upon receipt. 1-1/2% per month interest will be added to invoices 30 days or more past due. Shipper will be liable for any collection and legal expenses incurred by H. D. Auston Moving Systems, LLC. in obtaining full payment of its invoice. 6. Deposits A deposit is required at time of booking. The deposit will be applied to the final moving bill. 7. Refunds 14 days or more = full refund, 10 days = ½ refund or a full transfer of credit to another date within 1 month, 7 days or less = no refund or a full transfer of credit to another date within 1 month. 8. Unforeseen Contingencies H. D. Auston Moving Systems, LLC is not responsible for unforeseen contingencies. All estimates are based upon exclusive use of elevators and loading areas. H. D. Auston Moving Systems, LLC is not responsible for delays such as those resulting from construction activity, elevator failure or nonexclusive use of the elevator. 9. Changes to Scope of Services Shipper is responsible for charges resulting from changes in the size, scope and/or conditions of the move. 10.Any dispute arising under or in connection with the agreement or related to any matter which is the subject of the agreement shall be subject to the exclusive jurisdiction of the state and or federal courts located in Greenville, South Carolina. 11.This contract shall be governed by and interpreted in accordance with the laws of South Carolina. 12. Payments - H D Auston Moving Systems, LLC reserves the right to collect for payment prior to completion of the move. A 5% surcharge will be added to invoices with NET 7 terms. A 10% surcharge will be added for NET 30 Invoices. Interstate and intrastate moves require a 30% deposit, with the balance paid at or prior to delivery. Usually chips or dents are not repairable. Surface impressions can be made on the furniture when writing on a single piece of paper. Assembly instructions frequently suggest that the connecting hardware pieces be glued in place. This does not significantly improve the structural integrity of the pieces, but does not make disassembly impossible without creating substantial, un-repairable damage.There are three options for how your furniture will be handled during the move.Option 1 You choose to dissemble all pressboard, particleboard and/or engineered wood furniture prior to the move. You assume all responsibility for damage to the pressboard, particleboard, and /or engineered wood furniture, which may occur during the disassembly of the furniture.Option 2 You have engaged the services from another individual or company to disassemble all pressboard, particleboard and/or engineered wood furniture prior to the move.
